Deputy Minister of Investment and Downstream Industries/Deputy Head of BKPM Todotua Pasaribu introduced the latest breakthrough in business licensing system, namely Fictitious Positive (FikPos) which has been implemented in the Risk-Based Online Single Submission (OSS) system since early June 2025. This innovation was presented at the Regional Leaders Leadership Orientation Wave II at IPDN Jatinangor, Sumedang Regency.
What is Fictitious Positive?
Fictitious Positive is a revolutionary principle in the business licensing system stating that licensing applications that have met all requirements will be automatically considered approved if they do not receive responses from authorities within the timeframe according to Service Level Agreement (SLA).
This system is legally valid and becomes a bureaucratic reform breakthrough to improve efficiency and transparency of licensing services throughout Indonesia.
Transformation of Licensing Requirements
Todotua explained significant changes in managing basic licensing requirements. "Requirements such as PKKPR (Spatial Utilization Activity Conformity Approval), location permits, AMDAL, and PBG are now made post-audit, so the process can run while operating," he explained.
This approach allows business actors to start business activities faster without being hindered by lengthy licensing processes.
Importance of Regional Role in Investment
On this occasion, Todotua emphasized the crucial role of regional heads and their apparatus in encouraging investment to improve regional economy. DPMPTSP as the spearhead of investment services in regions has great responsibility in implementing this system.
"This forum is a moment for direct face-to-face meetings with Regional Governments, because our ministry will interact extensively with functions at Provincial and Regency/City levels," Todotua emphasized.

BKPM opens wide opportunities for Regional Governments to consult on investment. All licensing is managed in one OSS platform with centralized control but implementation involving regions.
